Can no-win, no-fee lawyers help with claiming compensation for assault injuries?

If you are injured as a victim of violent crime, you are entitled to claim compensation. The Criminal Injuries Compensation Scheme (CICS) compensates blameless victims of violent crime. Compensation can be paid for both mental and bodily injuries resulting from violent crime.
There are various eligibility requirements you must meet in order to receive compensation under the scheme. One of these requirements is that your injury must be serious enough to qualify for the minimum award of ?1000. This means that temporary bruising or cuts will not ordinarily suffice, although different rules apply for victims of sexual assault. The Scheme works out the compensation payable by a table setting out the ?standard amount of compensation? or ?tariff award? for various types of injuries.
It is also possible to obtain further compensation for loss of income and medical expenses if you have qualified for the tariff award (but not the other way around). You should speak to a personal injury lawyer about whether you have a claim for compensation under the scheme.
Another qualifying rule is that the incident must have occurred less than two years ago. If you try to make a claim outside of this two year period you will have to demonstrate why your claim should be accepted ? this can complicate things and you are advised to get legal advice from a personal injury lawyer as soon as possible.
You may be able to get a no win no fee lawyer to undertake your case for you. However, usually you cannot claim your legal costs back when making a claim under the Scheme. For this reason, a no-win, no-fee lawyer may be an unsuitable way of getting legal advice, and a no-win, no-fee lawyer might not be willing to take your case on.
If, however, you are considering suing the offender for personal injury compensation through the civil court, then using a no win no fee lawyer may be appropriate. Time limits also apply for suing through the civil courts, so you should consult a no-win, no-fee lawyer sooner rather than later to ensure you receive your compensation.
